NRMA driver training terms and conditions

General Terms

In addition to the General Conditions, the following additional terms and conditions (Terms) apply to the provision of services provided by NRMA Driver Training Pty Ltd ACN 122 086 248 (NRMA). These Terms apply to the participant and the person who has entered into a legally binding contract with NRMA where the participant is under 18, as the context requires (you). Since you are bound by both the General Conditions and these Terms, please review them all carefully.
NRMA may vary any of these Terms at any time at its sole discretion (including where required by TfNSW or for other reasons). Where you have already accepted these Terms, we will use all reasonable endeavours to ensure that you are not materially adversely affected by such variations.
Other than as required by law (including any guarantees which cannot be excluded under the Australian Consumer Law), NRMA does not provide any warranties or guarantees about the material contained in any training materials used or provided in any courses that it provides. These Terms are governed by the laws of New South Wales, Australia. Including, such as or similar words are not words of limitation.
These General Terms apply to all of the following offerings, in addition to any specific terms applicable to those offerings set out below in each relevant section.

All information about our goods and services on this website, or available through our call centre, has been provided 'as is'. Although NRMA has endeavoured to provide information which is believed to be correct at the time of entry, and other than as required by law (including any guarantees which cannot be excluded under the Australian Consumer Law), we make no representation or warranty that the information, including any descriptions of the goods or services is accurate, complete, reliable, current or error-free.
Prices and availability of services are subject to change at any time without notice. NRMA members may receive discounted prices, and occasionally the NRMA may offer discounts to non-members. Member and non-member offers are subject to change at any time and without notice, and notice of such changes will be provided online.
NRMA reserves the right to correct pricing errors at any time. In the event we discover a pricing error, we will attempt to notify you as soon as possible about the error and, if you decide against the purchase, we will process a refund for the item or items in question.
Unless otherwise indicated on this website, all goods and services available for purchase are priced in Australian Dollars and inclusive of GST.
The goods and services offered on this website and through our call centre are only available to persons who are capable of entering into a legally binding contract with NRMA. Without limiting the foregoing, by purchasing a good or service offered on our website or through our call centre, you warrant to NRMA that you are either 18 or more years of age or otherwise possess legal parental or guardian consent, and that you are authorised and able to make payment in the manner you have selected. You also warrant to NRMA that all information given by you to NRMA through this website (including names, contact and address details, and credit card details) are correct.
We offer a variety of services, however our provision of those services may depend on the participant's individual requirements.
Lessons must be booked via one of the following channels authorised by us:
1. NRMA Driver Training website www.mynrma.com.au.
2. NRMA Driver Training Call Centre 1300 696 762.
3. NRMA Driver Training contracted instructor, operations manager, franchisee representative, or other authorised representative.
All bookings must be paid for in full at the time the booking is created.Payments (for lessons or vouchers) can be made with a valid credit/debit cards (Visa, MasterCard) can be made online or through our call centre, via our secure payment gateway.
You must hold a current NSW/ACT driving licence (Class C LRN or C) or equivalent overseas licence and carry it with you at all times during a lesson.
By booking with us, you consent to receive further communications (including electronic communications) from the NRMA Group, including NRMA Driver Training, and its franchisees. Your information will be treated in accordance with the NRMA Privacy Policy.
NRMA collects, holds, and discloses personal information in accordance with its Privacy Policy. The NRMA collects personal information of participants (including name, contact details, gender, age, and driver’s licence number) in order to provide the particular services requested. The NRMA also collects information about the person who books and / or pays, including name and contact details. You may nominate an emergency contact in which case the NRMA will collect that emergency contact’s name and contact details. You may also nominate your emergency contact to have third party authority, in which case the NRMA will also collect their date of birth for identification purposes. If you provide the personal information of any other person, you must ensure that you have the authority to provide it.If you do not provide this information, we may not be able to provide our goods or services to you. NRMA’s Privacy Policy contains information about how you may access and correct personal information that we hold about you, or raise any concerns about our how we treat your personal information.
No contract for the purchase of services will be formed until your order has been accepted by us by sending you a receipt or invoice number. The contract will be deemed to be formed at the time and place where you receive our acceptance. We reserve the right to reject your order for any reason. You warrant that any purchase made by you from us is not for the purpose of commercial resale.
These Terms and the laws of New South Wales, Australia, apply to all transactions for the purchase of goods and services through this website or our call centre. No conditions or warranties apply or are given unless expressly set out in these Terms. NRMA does not exclude any rights and remedies available to you in terms of the Consumer and Competition Act 2010 (Cth) or any similar State or Territory legislation in relation to the provision by us of any goods or services via the website which cannot be excluded, restricted or modified. Otherwise we exclude all conditions and warranties which may be implied by law.
To the extent permitted by law, our liability for breach of any implied warranty or condition which cannot be excluded is restricted, at our option, to the re-supply of the lesson or the payment of the cost of having the lesson re-supplied.
Except for any liability which cannot be excluded by law or that is caused by our negligence, we, our related bodies corporate and our and their officers, employees, franchisees, contractors and agents shall not be liable for any loss, damage, liability or personal injury which is suffered, incurred or sustained by you or a third party (including but not limited to indirect or consequential loss) as a result of:
1. your participation in a lesson, or attendance at or participation in a course (including a module of the NSW Safer Drivers Course for Learners);
2. your failure or refusal to follow a reasonable instruction or direction of your instructor or facilitator before or during a lesson;
3. you being assessed by your instructor as an unfit or unsafe driver;
4. your instructor or facilitator terminating your participation in a lesson or course in any of the circumstances set out in these Terms;
5. you continuing to drive after you have been assessed as unfit or unsafe to drive by your instructor;
6. your breach of these Terms; or
7. your vehicle being assessed by your instructor as being unsafe to drive and/or un-roadworthy.
You indemnify and agree to keep us and our related bodies corporate and our and their officers, employees, contractors, franchisees and agents indemnified against any loss, damage, liability, costs and expenses suffered of incurred by us or them in connection with your breach of these Terms.
We do not accept any liability whatsoever for personal property that is left in any instructor supplied vehicle, your vehicle, on our premises, or on the premises where any of our services are provided.
We do not accept any responsibility whatsoever for the outcome of any course you undertake, or any driving test or assessments you take.

TfNSW Safer Drivers Course

NRMA is approved by Transport for NSW (TfNSW) to deliver the NSW Safer Drivers Course for Learners (SDC). NRMA conducts the SDC in accordance with the course curriculum provided by TfNSW, which includes Module 1 (Theory) and Module 2 (Practical) (collectively, the Modules)

Booking and attendance
To attend an NRMA SDC participants must:
1. be under 25 years of age;
2. hold a NSW learner licence;
3. hold a NSW learner logbook which is up to date; and
4. have recorded a minimum of 50 driving hours (3-for-1 Structured Driving Lesson Scheme bonus hours excluded).
Participants must bring their learner licence and learner logbook to both Modules of the SDC. In the event that participants are unable to provide evidence of the above listed items on the day, they will not be eligible to participate in the Modules on that day, a new booking will be required and you may forfeit the full fee.
Participants must attend the entirety of the course and complete both Modules within 30 days of each other to be eligible for the allocated logbook hours.
Participants must leave at least 30 days between completing the Modules and sitting their driver licence test.
Postponement or cancellation by NRMA
NRMA has the right to cancel or postpone Modules:
1. on 24 hours’ notice if minimum numbers are not received by that time; or
2. by giving as much notice as possible for unforeseen circumstances,
in which case we will use reasonable endeavours to arrange for attendance at the relevant module at a different time.

Cancelling or rescheduling by you
If you cancel your Module 1 session more than 5 business days before the scheduled session, NRMA will provide a full refund of the course fee. If you cancel 5 business days or less before the scheduled Module 1 session, you will forfeit 100% of the course fee. Module 1 sessions cannot be transferred to another person.
You may reschedule your Module 1 session more than 5 business days prior to the scheduled session at no cost. If you reschedule your session after then, a new session will be required and you may forfeit the full course fee.
If you cancel or reschedule your Module 2 session, NRMA will make all reasonable attempts to reschedule your cancelled session, however, you may forfeit the full course fee. Module 2 sessions cannot be transferred to another person.
If a participant is unable to complete the scheduled Module 2 session within 30 days from completing their Module 1 session, they will be required repeat Module 1 and an additional course payment fee will apply.

Non-attendance policy
Should a participant not attend their scheduled session for either Module 1 or Module 2, then a new session will be required and the full course fee will be forfeited.

Late attendance and leaving early policy
If a participant arrives more than 15 minutes after the scheduled Module 1 session start time, or leaves more than 15 minutes prior to completion of the Module 1 session, a new session will be required and the full course fee may be forfeited.
For the Module 2 session, participants must be ready to commence the lesson 10 minutes prior to the agreed session time. If a participant turns up outside these times, the instructor may in his/her/their reasonable discretion choose not to proceed with the session and in such circumstances you will be liable for the cost of the lesson.
Cancellation or rescheduling once a Module has commenced
NRMA has the right to terminate a participant’s attendance at or participation in a Module at any time if the participant:
1. engages in any behaviour that results in the facilitator or another participant in the Module feeling unsafe or threatened;
2. is overly disruptive, aggressive or confrontational;
3. is or appears to be impaired by or under the influence of drugs, alcohol or medication;
4. uses inappropriate language (including without limitation language that is discriminatory, offensive, harassing or otherwise inappropriate);or
5. wears inappropriate clothing or footwear where specific clothing or footwear are required due to venue requirements - for example no thongs or singlets where the Module is held in an RSL (it is the participant’s obligation to determine whether the specific venue has any clothing or footwear requirements),
in which case a new session will be required and you will forfeit the full course fee.
NRMA may terminate a participant’s attendance at Module 2 if:
1. the participant engages in any behaviour that the instructor determines is reckless;
2. the participant fails to comply with the reasonable instructions or directions of the instructor before or during Module 2;
3. the participant fails to comply with any special conditions on their license, i.e. wearing of glasses/contacts;or
4. the instructor has assessed the participant’s driving skills and competence and deems the participant to be unfit or unsafe to drive.
If a participant show signs of fatigue that the facilitator believes could impact their learning the facilitator may recommend that they not attend the Module. NRMA will make all reasonable attempts to reschedule the cancelled session, however you may forfeit the full course fee.

Privacy
In addition to the information listed above, the NRMA collects information in the log book to allow you to participate in the Safer Driver Course, and for other purposes associated with your participation in that course (including any feedback). If you do not provide the requested personal information, you may not be able to attend the course.
NRMA will disclose your personal information to TfNSW, which may use it for the purposes of:
1. verifying a learner driver's successful completion of the course;
2. investigating incidents that took place during participation in a Module; and/or
3. contacting the Learner to discuss feedback on the course.
Otherwise TfNSW will not use or disclose your personal information without your consent unless authorised by law. Your personal information will be held by TfNSW at 18 Lee Street Chippendale NSW and you can contact TfNSW to request to access or correct it.

Intellectual property
All intellectual property in any course material is owned by TfNSW.

NSW Safer Drivers Course Gift Voucher

NSW Safer Drivers Course gift vouchers (SDC Vouchers) are only redeemable in NSW for the SDC delivered by the NRMA.
SDC Vouchers are only valid for use by NSW learner drivers who:
1. are under 25 years of age;
2. hold a NSW learner licence;
3. hold a NSW learner logbook which is up to date; and
4. have recorded a minimum of 50 driving hours (3-for-1 Structured Driving Lesson Scheme bonus hours excluded).
SDC Vouchers must be redeemed within 12 months of the date of purchase.
SDC Vouchers are non-refundable (subject to applicable law), non-transferable and cannot be redeemed for cash or used in conjunction with any other discount or offer.
All SDC sessions for Module 1 and Module 2 are subject to availability. Cancellations and rescheduling can only be made in line with the SDC cancellation and rescheduling provisions set out in these Terms.
SDC Vouchers are system generated upon receipt of payment and automatically emailed to the NRMA Driver Training booking system account holder. The NRMA is not liable for the non-delivery of SDC Vouchers due to errors or omissions by the customer in providing their personal information (such as email address, mobile number, etc.).
SDC Vouchers contain a unique code which must be entered at the time of booking the SDC.

NRMA Driver Training

Driver training services are provided by NRMA or by its contracted instructors. Where NRMA is the provider, these terms govern the agreement between the participant (you) and NRMA. Where an instructor is the provider, that instructor provides the lessons in its own right, and these terms govern your agreement with the instructor. NRMA or the instructor (as the case may be) is referred to as "we", "our" and "us" in these Terms.

Lesson Bookings
You will be bound by the Terms you accept at the time of booking your lesson. If you book more than one lesson at the same time, the Terms applicable at the time of booking will apply to each lesson booked at that time.
Lesson bookings can be made up to 3 hours prior to lesson time, pending instructor availability.
We reserve the right to offer certain lesson and package types where additional booking and refund restrictions may apply. If any additional booking or refund restrictions do apply, we will notify you at the time any offer is made.

Fees and cancellations/rescheduled bookings
You must give more than 18 hours’ notice to cancel a lesson booking or your lesson fee will be forfeited.
You must give more than 18 hours’ notice to reschedule a lesson booking or your lesson fee may be forfeited.
We reserve the right to reschedule a lesson to a mutually convenient time subject to the provision of reasonable notice. We reserve the right to refuse to provide a lesson where you are unfit to operate a vehicle as reasonably determined by us, in which case your lesson fee will be forfeited.

Lessons
On-road lessons commence and end at the pick-up point you selected at the time of booking the lesson. The duration of the on-road lesson is the time period that you selected at the time of booking, and includes lesson briefing and de-briefing (which are not on-road).

Provision of Lessons
You must not wear high heels, thongs or other footwear which in the opinion of the instructor may cause safety concerns with the foot controls. A flat, enclosed and secure shoe is recommended.The instructor may refuse to provide or continue a lesson where there are safety concerns with the foot controls, in which case your lesson fee will be forfeited.
Mobile phones must be switched off prior to entering the training vehicle.
You must be ready to commence the lesson 10 minutes prior to the agreed time. If you do not turn up at the agreed time for your lesson, your instructor will wait up to 15 minutes and may at the instructor's reasonable discretion deduct this from the total lesson time. If you turn up outside these times, your instructor may in their reasonable discretion choose not to proceed with the lesson and in such circumstances you will forfeit the lesson fee.
While every endeavour is made to commence the lesson at the scheduled time and with the scheduled instructor, no responsibility can be taken for circumstances beyond our control which may delay the start time or result in a change of instructor. If there are circumstances beyond our control which have delayed the start time of your lesson, we will offer you the full lesson time or, if that is not possible, we will offer you a lesson at another time that is mutually convenient.
You must comply with the reasonable instructions or directions of your instructor at all times, before or during a lesson.
We reserve the right to terminate a lesson if:
1. you engage in any behaviour that your instructor determines is reckless;
2. you fail to comply with the reasonable instructions or directions of your instructor before or during a lesson;
3. you fail to comply with any special conditions on your license, i.e. wearing of glasses/contacts;
4. you engage in behaviour that results in your instructor feeling unsafe or threatened, you are overly disruptive, aggressive or confrontational, or you use language that is discriminatory, offensive, harassing or otherwise inappropriate;or
5. your instructor has assessed your driving skills and competence and deems you to be unfit or unsafe to drive.
In the event that a lesson is terminated under the circumstances listed above you will forfeit the lesson fee.

Licence Test bookings
You may book a “licence test” lesson with your instructor if:
1. you have had at least one lesson with your instructor and your instructor confirms that you are ready to sit your Ps test (however this does not constitute a representation that you will pass your Ps test and we are not responsible in any way for any test or other costs associated with your booking and/or sitting your Ps test);
2. you have booked your Ps test;
3. you have confirmed your instructor’s availability for the relevant period (see below);and
4. the registry location is within the instructor’s normal area.
If you do not comply with any of the above requirements we reserve the right to cancel the booking at any time, in which case you may forfeit the lesson fee. You are solely responsible for any costs incurred by you in relation to booking or sitting your Ps test.
The “licence test” lesson consists of a pick up from the location selected at the time of booking one hour before the scheduled Ps test (although a longer period may be required in some circumstances, such as where a test is booked out of the instructor’s area), a short on-road lesson prior to the Ps test (the length is variable and depends on a number of factors including traffic conditions), use of the instructor’s vehicle for the Ps test (while the instructor waits at the registry), and transport from the registry back to the pick up location. You may not drive from the registry regardless of the result of your Ps test.

Use of own vehicles
If you are driving in your own vehicle:
your instructor must be qualified to provide instruction in relation to the transmission type of your vehicle;

your instructor must first assess that your vehicle is roadworthy (only a basic external inspection will be carried out); and

you must ensure that the following requirements are met in relation to your vehicle:
1. the registration of your vehicle is valid, current and can be validated;
2. you are the registered owner of the vehicle, or you have the consent of the registered owner;
3. you hold current compulsory third party insurance and comprehensive insurance cover for your vehicle;
4. you comply with the terms and conditions of your compulsory third party insurance and comprehensive insurance cover for your vehicle;
5. the person who is driving the vehicle is covered by the above insurances;
6. the tyres are correctly inflated (air pressures must reflect the manufacturer's recommendation as a minimum), have appropriate levels of tread and are not damaged;
7. all indicators and brake lights are working;
8. seats and seat belts are in good working order and are not damaged or twisted;
9. any loose items in the cabin of the vehicle are securely stowed in the cargo (boot) area;
10. the windows and interior are clean;
11. the windscreen is not cracked and shows no signs of damage; and
12. the vehicle has sufficient petrol/charge to last the course of the lesson (minimum requirement is a quarter of a tank).
20. You must notify your instructor prior to commencing a lesson if your car is fitted with dashcams or other recording devices, or global positioning or monitoring systems with the capacity to identify the location of the vehicle, and the manner in which it is operated.

21. If driving lessons take place in your own vehicle, you warrant that you are covered by compulsory third party insurance and that your vehicle is covered by comprehensive insurance.

Instructor Supplied Vehicle

22. On-road driving lessons are provided in manual or automatic transmission vehicles. The available transmission type can be selected when booking.

23. Instructor supplied vehicles may contain global positioning and monitoring systems with the capacity to identify the location of the vehicle and the manner in which it is operated.

Fitness to drive

24. In the interests of safety, your instructor may assess your driving skills and competence at any time.

25. Your instructor may refer you to another instructor or to a supervisor for further assessment of your driving skills at your instructor’s sole discretion.

Driver Training Lesson Packages & Vouchers

General
1. NRMA driver training vouchers (DT Vouchers) entitle the recipient nominated at the time of purchase to the specified number of lessons described in the relevant DT Voucher(s) purchased.
2. DT Vouchers are valid only at the NRMA Driver Training school nominated at purchase of the DT Voucher. DT Vouchers must be used within the particular post code or location they were originally purchased for.
3. DT Vouchers are valid for 12 months from date of issue, are non-refundable (subject to applicable law), non-transferable, and cannot be extended, redeemed for cash, or used in conjunction with any other discount or offer.
4. Once you have purchased DT Vouchers you must make a booking for the type of driving lessons described in the relevant DT vouchers. DT Vouchers contain a unique code which must be entered at the time of booking the driving lesson. All lesson bookings are subject to availability and these Terms. Cancellations and rescheduling can only be made in line with the driver training services cancellation and rescheduling provisions set out in these Terms.
5. DT Vouchers are system generated upon receipt of payment and automatically emailed to the NRMA Driver Training booking system account holder. NRMA is not liable for the non-delivery of DT Vouchers due to errors or omissions by the customer in providing their personal information (such as email address, mobile number, etc.).
  
  NRMA member 1 hour DT Voucher packages
6. Available to NRMA members only. A valid NRMA membership number is required at the time of booking.
7. The current member 1 hour DT Voucher offer is as follows:
  1. Where you purchase a 5 x one hour DT Voucher package you will receive a 5% discount off the total cost of the package.
  2. Where you purchase a 10 one hour DT Voucher package you will receive 10% discount off the total cost of the package.
8. The usual price of a 1 hour driving lesson is up to $96.00.
  
  90 minute DT Voucher packages
9. Available to NRMA members and non-members.
10. The current 90 minute DT Voucher offer is as follows:
  1. Where you purchase a 4 x 90 minute DT Voucher package, you will receive a 5% discount off the total cost of the package.
  2. Where you purchase an 8 x 90 minute DT Voucher, you will receive a 10% discount off the total cost of the package.
11. The usual price of a 90 minute driving lesson is up to $144.00.
